Notice of Passing of an Interim Control By-law 56-2026

Pursuant to subsection 38 (3) of the Planning Act, R.S.O. 1990, c. P.13 (as amended), take notice that the Council of the Corporation of the City of Brantford has passed an interim control by-law.

Purpose and Effect of the Interim Control By-law

The purpose of Interim Control By-law 56-2026 (the Interim Control By-law) is to pause the establishment of uses which do not align with the definition of “area of employment” contained in subsection 1(1) of the Planning Act so that the City of Brantford can undertake a land needs assessment and a comprehensive employment area review as part of a broader Official Plan Review.

The City will evaluate the alignment of current employment lands with the definition of area of employment found in subsection 1(1) of the Planning Act and ensure that employment lands remain protected over the long term for major economic uses (e.g. manufacturing, goods movement, research and development) as contemplated in the Provincial Planning Statement, 2024. Public consultation about the future of employment areas will be occurring throughout the Official Plan Review.

The Interim Control By-law applies to lands shown in the key maps included at the end of this notice (and attached as Schedule A to the Interim Control By-law). Lawfully established existing uses are permitted to continue, and the following uses as defined in City of Brantford Zoning By-law 124-2024 can still be established during the period of interim control: asphalt plant; brewery, distillery, or winery; cannabis production and processing facility; concrete batching plant; food processing plant; manufacturing use; research use; transportation terminal; warehouse; and accessory uses, including accessory office or accessory retail.

Effective Date and Period of Application

The Interim Control By-law has an effective period of one (1) year from the date of passing (May 26, 2026).

Pursuant to subsection 38 (2) of the Planning Act, City Council may amend the Interim Control By-law to extend the period of time during which it is in effect to a total period not exceeding two (2) years from the date of passing.

Appeal Rights

Any person or public body who has received a notice of the passing of the Interim Control By-law may appeal to the Ontario Land Tribunal within 50 days after the date of the passing of the by-law. Such an appeal must be submitted to the Clerk of the City of Brantford at:

The notice of appeal must set out the reasons for the appeal and must also be accompanied by the fee required by the Tribunal (available at www.olt.gov.on.ca). The last day for filing a notice of appeal is July 15, 2026.

Subject Lands

The Interim Control By-law applies to a portion of the General Employment and Prestige Employment land use designations set out in the City of Brantford Official Plan which comprise the City of Brantford’s employment areas. The affected properties are shown in Figures 1, 2, and 3.
