Renting in Brantford

The Residential Tenancies Act (RTA) governs the relationship between landlords and tenants in Ontario. It sets out their rights and responsibilities and includes rules for rent increases, evictions and maintenance. 
While many renters in Ontario are covered by the RTA, it does not apply to all rental situations. Some of the rental situations that the RTA does not apply to includes:

• Emergency shelters
• Hospitals or nursing homes (long-term care facilities)
• Student residents or dormitories
• Temporary or seasonal use units
• Units that share a kitchen or bathroom with their landlord or a member of the landlord’s immediate family
• People not on a lease

Please note that the Province of Ontario is responsible for the Residential Tenancies Act (RTA). The City of Brantford does not administer or enforce the RTA; however, as a housing provider, the City is required to comply with the RTA in the operation of its municipal housing units.

In Ontario, the Provincial Landlord and Tenant Board (LTB) enforces the Residential Tenancies Act, 2006 (RTA), which governs the tenant-landlord relationship.

The LTB provides information about rights and responsibilities under the RTA and resolves disputes between tenants and landlords. The LTB provides information about, and the enforcement of rules related to:

• Evictions and how to manage them
• Leases and how to read them
• Rent increases
• Rights and responsibilities of a tenant
• Landlord rights and responsibilities, including maintenance obligations
• Conflict resolution options

Please be aware that the City of Brantford does not enforce the Residential Tenancies Act or participate in Landlord and Tenant Board proceedings that deal with private rental properties. These are provincial matters. However, the City does participate in LTB proceedings involving municipally owned housing units or sites.
