Notice for a Public Meeting: City-Initiated Official Plan Amendment

Purpose and effect of proposed application
Application OP-01-25 is a City-initiated amendment to the City of Brantford Official Plan, to establish policy direction for the conversion of existing residential rental buildings with six or more units to condominium ownership. The proposed policies introduce criteria for evaluating condominium conversion applications, as well as additional submission and study requirements that must be satisfied by an applicant.
The following matters are proposed to be addressed in the Official Plan:
- Section 3.1 will be amended by adding a statement regarding the importance of creating and maintaining rental and/or affordable rental housing options in the City of Brantford.
- A set of policies will be added to Section 9.3, including:
- A statement encouraging the maintenance of a 3% city-wide residential vacancy rate.
- A requirement to submit a Residential Housing Conversion Study demonstrating that the proposed conversion will not significantly impact the City’s overall supply or range of rental housing when the vacancy rate is below 3%.
- A requirement to submit a Building Assessment Report, along with documentation demonstrating that existing tenants have been informed of the proposed conversion as well as their rights under the Residential Tenancies Act.
- A policy allowing conversions to be considered for approval where all units are to remain or become affordable rental and/or affordable or attainable ownership housing units.
- Subsection 9.11.h will be amended by adding “Building Assessment Report” to the list of Required Studies that the City may request when processing a development application under the Planning Act. This new study requirement will assess the condition of a property's structural and system components to ensure compliance with applicable safety and regulatory standards. It will also support informed decision-making by providing a comprehensive evaluation of the building's existing conditions, including individual units and common elements in condominiums, and identify any necessary future repairs.

- A paper copy of the proposed Official Plan Amendment will also be made available for public viewing on May 21, 2025, at the Customer Service Counter, 1st Floor, City Hall, 58 Dalhousie Street, Brantford, ON N3T 2J2 between 8:30 a.m. and 4:30 p.m., Monday to Friday.
- A copy of the Staff Report regarding the proposed Official Plan Amendment will be available on the City of Brantford website the Friday before the meeting. It can also be forwarded electronically or as a paper copy to interested parties through a written request to the Clerk, City of Brantford, City Hall, 58 Dalhousie Street, Brantford, ON, N3T 2J2 or via email: clerks@brantford.ca.
- You may attend the Public Meeting in-person on virtually and you are encouraged to provide comments in writing or via email in advance of the meeting. Comments can be submitted by emailing the City Staff Contact noted above anytime prior to the meeting.
- In-Person: no registration is required. The Meeting Chair will call for members of the public in attendance to speak to the item.

- Article 18 in the City of Brantford’s Procedural By-law provides rules of holding hybrid meetings at the City of Brantford.
- If you wish to be notified of the decision of the City of Brantford on the proposed Official Plan Amendment, you must make a written request to the Clerk, City of Brantford, City Hall, 58 Dalhousie Street, Brantford ON, N3T 2J2.
- If a person or public body would otherwise have an ability to appeal the decision of the City of Brantford to the Ontario Land Tribunal, but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of Brantford before the proposed Official Plan Amendment is adopted, the person or public body is not entitled to appeal the decision. Furthermore, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal (OLT) unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
- Personal information collected and recorded at the Public Meeting or through written submissions on this subject, is collected under the authority of the Municipal Act, 2001, as amended, and the Planning Act, 1990 R.S.O. 1990, c.P.13 and will be used by Members of Council or Committee and City of Brantford staff in their consideration of this matter. The written submissions, including names and contact information and the associated reports arising from the public participation process, will be made available to the public, including publishing on the City’s website. Video recordings of the Statutory Public Meeting may also be posted to the City of Brantford’s website. Application to amend the City of Brantford Official Plan
This guide contains important general information for interested parties regarding the notification and public input process for applications to amend the Official Plan.
- Members of the public may contact the Planning and Development Services Department for further information regarding the proposal.
- In order to gain input regarding the proposed Official Plan Amendment, prior to meeting of the Planning Committee dealing with the application, a Notice of Public Meeting (included in this mailing) is forwarded to the following:
- Other persons who have submitted a written request for notice or who have individually provided their name and address to Planning and Development Services.
- A variety of agencies as set out in the regulations.
- In the case of a petition, only the author of the petition is notified of the Public Meeting, over and above those normally notified as set out in Item 2. above.
- Persons receiving a Notice of Public Meeting are not obligated to submit written comments or provide comment as part of the Public Meeting. Parties who wish to submit written comments should do so as early as possible prior to the Public Meeting so that it can be included with the Agenda for perusal by the Planning Committee in advance of the Public Meeting.
- A copy of the Staff Report regarding the proposed Official Plan Amendment will be available to interested parties through a written request to the Clerk, City of Brantford, City Hall, 58 Dalhousie Street, Brantford, ON, N3T 2J2 or via email: clerks@brantford.ca. The report is available to the Clerk for forwarding at noon on the Friday before the Public Meeting date. The report will also be available on the City of Brantford website the Friday before the meeting.
- The City of Brantford Public Meetings are being held in a hybrid meeting format consisting of in person and/or virtual attendance.
- Notice of the Decision of Brantford Council regarding the application for Official Plan Amendment is available to interested parties through written request to the Clerk, City of Brantford, City Hall, 58 Dalhousie Street, Brantford, ON, N3T 2J2 or via email: clerks@brantford.ca.
- In the event that the Official Plan Amendment is approved, an Official Plan Amendment is subsequently adopted by City of Brantford Council. The Clerk will notify the following of the adoption of the Official Plan Amendment:
- All parties who have given the Clerk a written request for the Notice of the Adoption of an Official Plan Amendment.
- All parties who made oral submissions at the Public Meeting or made written submissions before the Official Plan Amendment is adopted.
- A variety of agencies as set out in the regulations.
- An appeal may be filed by a specified person, as defined by the Planning Act, a public body, or the registered owner of the land to which the amendment applied, if the specified person, public body or owner made oral submissions at a public meeting or written submissions to Council, the Minister, the approval authority, or in the case of a request to amend the plan, the person or public body that made the request.
Appeals must be filed within twenty days from the day of giving the Notice of the Adoption of an Official Plan Amendment, to the Ontario Land Tribunal by filing a Notice of Appeal to the Clerk of the City of Brantford, Attention: Chris Gauthier, City Clerk, 58 Dalhousie Street, Brantford, ON, N3T 2J2.
