Clean Air By-law

In an effort to ensure a healthier environment for residents and visitors, all Brantford City property is smoke-free.

Where smoking or vaping is prohibited on City property

As outlined in Brantford’s Smoking – Clean Air By-law, there is no smoking of tobacco or cannabis and no vaping on City property.

That means no smoking or vaping at: 

  • City-owned administrative buildings, including parking lots
  • City-owned recreation centres
  • City-owned sports facilities
  • Parks
  • Sidewalks on City building property or within a public park
  • Trails

Under the Smoke-Free Ontario Act, 2017, smoking tobacco or cannabis or vaping of any substance is prohibited in any enclosed workplace, any enclosed public place and other places designated as smoke-free and vape-free as stipulated by provincial legislation. This includes, but is not limited to:

  • Bar and restaurant patios, whether they are covered or not, and within 9 metres of these patios
  • Child care facilities and related places
  • Hospital grounds
  • School grounds and within 20 metres of school grounds

Where smoking or vaping is permitted

Smoking or vaping is permitted on private property (subject to landowner policies or permissions) and on sidewalks adjacent to a City street. 

 Enforcement

City of Brantford by-law officers are responsible for enforcement of the Clean Air By-law.  A ticket and fine will be issued to those who do not follow the law with a maximum fine of $5,000.

Healthy Brantford

The decision to go smoke-free reflects City Council’s approval to implement one of the goals of the Healthy Brantford Task Force to prohibit smoking on municipal properties. Healthy Brantford supports the health and wellness of all Brantford residents and visitors.
